Terms and conditions
These terms and conditions of sale are agreed between the company PATTON through its online sales website "WATCHES.FR", located at 16 Place Vendôme 75001 PARIS, France, registered on the Paris Trade and Companies Register under registration number 485147144 75, and any natural or legal person who wishes to make a purchase through the website "WATCHES.FR", hereafter referred to as the “Buyer”.
Scope
The purpose of these terms and conditions of sale is to define the contractual relations between WATCHES.FR and the Buyer, and the conditions that apply to all purchases made through the online store WATCHES.FR, whether by a professional customer or individual consumer. The purchase of a watch or service through this website implies full acceptance by the Buyer of these terms and conditions of sale.
These terms and conditions of sale shall prevail over all other general or specific terms that have not been expressly agreed by WATCHES.FR. We reserve the right to amend these terms and conditions of sale at any time. In this case, the applicable terms and conditions will be those in force on the date the Buyer places the order.
Characteristics of goods and services offered
The products and services offered are those which figure in the catalogue published on the website WATCHES.FR. These products, watches and services are offered subject to availability. Each product is accompanied by a description provided by the supplier; where the initials DF appear, the Buyer may have access to the supplier’s documentation.
The photographs in the catalogue are as representative as possible, but we cannot guarantee that they are a perfect representation of the product, especially with regard to colours.
Prices
The watch prices featured in the catalogue are in euros and inclusive of VAT, based on the VAT rate applicable on the date of order; any change in VAT rate may be applied to the prices of the products or services. WATCHES.FR reserves the right to amend its prices at any time; the Buyer shall be charged the price indicated in the catalogue at the time of order. The prices indicated include order processing, transport and delivery charges.
Orders
The Buyer, who wishes to purchase a watch, product or service, must:
- fill in the identification form in which he shall supply all the information required or provide his customer number if he has one.
- fill in the order form online and provide all the references of the products or services chosen.
- check and then submit his order.
- make the payment in the agreed conditions.
- confirm his order and payment. Confirmation of the order implies that the Buyer accepts these terms and conditions of sale, acknowledges that he has read and understood them, and waives any right to apply his own or any other terms and conditions of purchase. All the data provided and the confirmation registered act as proof of the transaction. Confirmation shall be deemed to constitute the requisite signature and acceptance of the operations made. The Seller will provide confirmation by email of the order registered.
Cancellation
Buyers who are non-professional natural persons are entitled to a seven day cooling-off period from the delivery of their order to return the product to the Seller for an exchange or refund without penalty, with the exception of shipping costs. The objects must not have been worn, and must bear no scratches or traces. They must be returned in their origin box in perfect condition with the papers and warranties.
Payment methods
Payment must be made upon the submission of your order.
Payments may be made by credit or debit card; they will be made via the secure payment system PayPal which uses the SSL (Secure Socket Layer) protocol to automatically encrypt the submitted information, so that no third party can obtain this information during its transfer.
An invoice showing the VAT for the products purchased will be sent out by post.
Delivery
Watches are delivered to the address indicated on the order form which must be within the agreed geographical area. All risks are the Buyer’s responsibility from the time the goods leave the premises of WATCHES.FR.
In the event of damage during transport, the complaint must be lodged with the carrier within a period of three days following delivery. The delivery times are estimated and are not guaranteed.
Warranty
All the products provided by the Seller have a legal warranty in accordance with articles 1641 et seq. of the French Civil Code. The manufacturer warranties will be provided by WATCHES.FR.
Liability
The total or partial reproduction, exploitation, redistribution or use, for any reason whatsoever, of elements of this website, whether they be software, visual or audio, is prohibited. Any link or hypertext link is strictly prohibited without prior express written authorisation from WATCHES.FR.
Personal data
In compliance with the French law of 6 January 1978 relating to information technology, IT files and freedom, personal information may be subject to automated processing. WATCHES.FR reserves the right to collect information on Buyers, including through the use of cookies, and, if desired, to transfer the information collected to trading partners.
Buyers may object to the disclosure of their contact details by notifying WATCHES.FR. Similarly, users have the right to access and rectify their personal data, in compliance with the French law of 6 January 1978.
Archiving
WATCHES.FR shall archive all purchase orders and invoices for watches on a reliable and long-lasting medium, constituting a true copy in compliance with the provisions of article 1348 of the French Civil Code. The Seller’s computerised registers shall be considered by the parties as proof of communications, orders, payments and transactions between the parties.
Disputes
These terms and conditions of online sale are subject to French law. In case of dispute, jurisdiction is given to the competent courts of PARIS, even in the case of multiple defendants or third-party notice.
